How long does the investor must apply for a Pink Book for buyer after buying an apartment?

Clause 7, Article 26 of the Law on Housing stipulates the responsibilities of investors in commercial housing construction projects, including commercial apartment projects as follows:

Within 50 days since handing over the house to the buyer or since the time when the lessee has paid in full as agreed, procedures must be carried out to request a competent state agency to issue a Certificate for buyers, tenants to buy houses, except for cases where buyers, rent-purchasers voluntarily carry out procedures to apply for a Certificate. In case of building houses for rent, they are responsible for making and storing house dossiers according to the provisions of Articles 76 and 77 of this Law.

Clause 4, Article 13 of the Law on Real Estate Business 2014 also states:

Within 50 days since handing over the house or construction work to the buyer or from the date on which the lease-purchase expires, procedures must be carried out for a competent state agency to issue a certificate of land use right, ownership of houses and other land-attached assets for the purchaser or the lessee, unless the purchaser or the lessee requests in writing to carry out the procedures for certification by themselves.

The time limit for the investor in the construction of a commercial apartment project to apply for a Pink Book to the buyer is 50 days since the date of handing over the apartment, unless the buyer personally requests to go through the procedures for granting house ownership certificate.

Therefore, the investor must carry out procedures to apply for the pink book of the apartment to the buyer within 50 days from the date of handing over the apartment.

Clause 40, Article 2 of Decree No. 01/2017/ND-CP stipulates the time limit for issuance of Pink Book as follows:

- Issue of Pink Book for the first time: 30 working days. For mountainous communes, this time is extended by 10 days to 40 working days.

- Issuance of Pink Book due to purchase, sale and transfer: 10 working days. If in a mountainous commune, this time is 20 working days.
