Criminal prosecution for embezzlement

In Clause 1, Article 353 of the Penal Code 2015, amended in 2017, those who abuse their positions and powers to appropriate property they are responsible for managing with a value of VND 2 million or more or less than VND 2 million but in one of the following cases, they will be handled for the crime of property embezzlement.

- Have been disciplined for this act but keep violating it;

- Have been convicted of one of the following crimes: bribery; abusing positions and powers to appropriate property; abusing his power when performing official duties; not beeing cleared of criminal records but still commits violations.

Therefore, those who abuse their positions and powers to appropriate property of VND 2 million or more may be prosecuted for accepting bribes or appropriating assets of less than VND 2 million, but falling into one of the following cases: may also be subject to criminal prosecution.
